Terms of Use

1. Scope

These Terms of Use apply to the iOS app "Lumen" (hereinafter "App"), provided by Michael Porwol (hereinafter "Provider"). By downloading, installing, or using the App, you agree to these Terms.

2. Provider

3. Description of the App

Lumen is an app for the daily Ignatian Examen (examination of conscience). It serves as a tool for personal self-reflection and spiritual accompaniment. The App is not a substitute for the Sacrament of Confession, pastoral care, or therapy.

4. Usage Rights

The Provider grants you a personal, non-transferable, revocable right to use the App on your iOS devices. Commercial use, reproduction, or redistribution of the App or its content is not permitted without express authorization.

5. In-App Subscriptions (MAGIS)

The App offers optional paid subscriptions under the name "MAGIS". These unlock additional features such as advanced pattern analysis, consolation charts, and discernment of spirits.

6. Right of Withdrawal

As a consumer in the EU, you have the right to withdraw from a contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract was concluded.

To exercise your right of withdrawal, you can inform us of your decision to withdraw by email to michael@lumenexamen.com. Alternatively, you can process the withdrawal through Apple's refund process (reportaproblem.apple.com).

Note on digital content: For in-app subscriptions that are delivered immediately after purchase, the right of withdrawal may expire prematurely if you expressly consented to immediate performance and acknowledged that you thereby lose your right of withdrawal. Apple obtains this consent during the purchase process.

7. Data Storage

All personal data (journal entries, transgressions, resolutions, etc.) is stored exclusively on your device and encrypted with AES-256. Without your action, no personal data is transmitted to the Provider's servers or third parties. If you switch on the cloud backup as a MAGIS subscriber, a copy of your data — already encrypted on your device — is stored on a server in Germany; the Provider cannot decrypt it. The App only retrieves publicly available liturgical content (daily gospel) and pre-generated impulses from external sources. For further details, see our Privacy Policy.

8. Availability

The Provider endeavors to keep the App available and error-free at all times but does not guarantee uninterrupted availability or absence of errors. The App may be modified, updated, or discontinued at any time.

9. Disclaimer

The App is provided "as is". The Provider is not liable for data loss resulting from device defects, deletion of the App, or missing backups. It is strongly recommended to create regular backups using the App's export function. The App does not provide medical, therapeutic, or pastoral advice. The Provider's liability for slight negligence is limited to breaches of essential contractual obligations and to the typically foreseeable damage. This does not apply to damages arising from injury to life, body, or health.

10. Intellectual Property

All content, designs, texts, and features of the App are the intellectual property of the Provider or the respective rights holders (e.g., liturgical texts). Ignatian spirituality and the underlying prayers are common property of the Catholic Church.

11. Relationship with Apple

These Terms of Use are between you and the Provider (Michael Porwol), not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App. In the event of a defect or third-party claims regarding the App, the Provider (not Apple) is responsible. Apple and its subsidiaries are third-party beneficiaries of these Terms of Use and have the right to enforce these Terms against you.

12. Dispute Resolution

The Provider is not willing or obligated to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

13. Changes to Terms of Use

The Provider reserves the right to modify these Terms of Use at any time. In the event of significant changes, users will be notified within the App. Continued use of the App after a change constitutes acceptance of the new Terms.

14. Governing Law and Jurisdiction

The laws of the Federal Republic of Germany shall apply. For consumers, the mandatory consumer protection regulations of their country of residence shall apply. The place of jurisdiction for all disputes arising from or in connection with these Terms of Use is, to the extent permitted by law, the registered office of the Provider.
